Our total liability to you for all damages, losses, and causes of action shall not exceed the amount you paid TelescopeBuff in the 12 months preceding the claim (which is zero for our free content service).

11. Indemnification

You agree to defend, indemnify, and hold harmless TelescopeBuff and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

Before filing a claim against TelescopeBuff, you agree to try to resolve the dispute informally by contacting us at the information provided in Section 17. We'll try to resolve the dispute informally by contacting you via email.

Binding Arbitration

If we cannot resolve disputes informally, any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

The Federal Arbitration Act and federal arbitration law apply to this agreement. There is no judge or jury in arbitration, and court review of an arbitration award is limited.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
